La combinaci\u00f3n de directivas europeas pendientes de transposici\u00f3n, nuevas obligaciones en materia de cotizaci\u00f3n y reformas estructurales en contratos, jornada y transparencia salarial configura un escenario de&nbsp;<strong>alta exigencia normativa<\/strong>.&nbsp;<\/p>\n\n\n\n<p>Los departamentos de Recursos Humanos que no act\u00faen con anticipaci\u00f3n asumen&nbsp;<strong>riesgos legales, econ\u00f3micos y reputacionales evitables<\/strong>. A continuaci\u00f3n, repasamos los principales cambios que deben estar en el radar de cualquier equipo de RR. HH.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Salario M\u00ednimo Interprofesional: 1.221 \u20ac con impacto real en plantilla<\/strong>&nbsp;<\/h2>\n\n\n\n<p>El&nbsp;<strong><a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2026-3815\">SMI 2026<\/a><\/strong>&nbsp;se ha fijado en&nbsp;<strong>1.221 \u20ac mensuales en 14 pagas<\/strong>, lo que supone un incremento del&nbsp;<strong>3,1 %<\/strong>&nbsp;respecto al a\u00f1o anterior (17.940 \u20ac anuales).&nbsp;<\/p>\n\n\n\n<p>Desde el punto de vista de gesti\u00f3n, la novedad m\u00e1s relevante es la&nbsp;<strong>exenci\u00f3n fiscal aplicada a la subida<\/strong>, que evita que el aumento quede absorbido por el IRPF. Sin embargo, el impacto va mucho m\u00e1s all\u00e1 de las personas que perciben el salario m\u00ednimo.&nbsp;<\/p>\n\n\n\n<p>Las empresas deben:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Revisar sus&nbsp;<strong>tablas salariales internas<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Analizar el&nbsp;<strong>efecto arrastre<\/strong>&nbsp;en categor\u00edas pr\u00f3ximas al SMI&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Evitar&nbsp;<strong>distorsiones retributivas<\/strong>&nbsp;entre puestos con distinta responsabilidad&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>No hacerlo puede generar tensiones internas y conflictos laborales innecesarios.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Seguridad Social y cotizaciones: costes que siguen creciendo<\/strong>&nbsp;<\/h2>\n\n\n\n<p>En 2026 se consolidan varios ajustes que afectan directamente al&nbsp;<strong><a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2026-2548\">coste laboral por empleado<\/a><\/strong>:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Base m\u00e1xima de cotizaci\u00f3n:<\/strong>&nbsp;sube a&nbsp;<strong>5.101,20 \u20ac mensuales<\/strong>, aplicando la revalorizaci\u00f3n de pensiones (2,7 %) m\u00e1s un 1,2 % adicional.&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Mecanismo de Equidad Intergeneracional (MEI):<\/strong>&nbsp;alcanza el&nbsp;<strong>0,90 %<\/strong>&nbsp;(0,75 % empresa \/ 0,15 % trabajador).&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Cotizaci\u00f3n adicional de solidaridad:<\/strong>&nbsp;comienza a tener impacto real en&nbsp;<strong>perfiles de alta direcci\u00f3n y salarios elevados<\/strong>.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Ante este escenario, resulta imprescindible:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Simular escenarios de coste&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Revisar pol\u00edticas de&nbsp;<strong>retribuci\u00f3n flexible<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Planificar con antelaci\u00f3n la&nbsp;<strong>masa salarial<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Transparencia retributiva: el cambio m\u00e1s disruptivo del a\u00f1o<\/strong>&nbsp;<\/h2>\n\n\n\n<p>La&nbsp;<strong>Directiva europea 2023\/970<\/strong>, de obligada transposici\u00f3n en&nbsp;<strong>junio de 2026<\/strong>, supone un antes y un despu\u00e9s en <a href=\"https:\/\/www.consilium.europa.eu\/es\/policies\/pay-transparency\/\">materia de igualdad retributiva<\/a>.&nbsp;<\/p>\n\n\n\n<p>Sus principales implicaciones:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Obligaci\u00f3n de&nbsp;<strong>publicar bandas salariales<\/strong>&nbsp;en las ofertas de empleo&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reducci\u00f3n del umbral de brecha salarial justificable del&nbsp;<strong>25 % al 5 %<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mayor exposici\u00f3n a reclamaciones y auditor\u00edas&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Diferencias que hasta ahora pasaban desapercibidas quedar\u00e1n bajo escrutinio. HH. deben:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Auditar la&nbsp;<strong>brecha salarial interna<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Estandarizar criterios retributivos&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Preparar una&nbsp;<strong>estrategia de comunicaci\u00f3n interna y externa<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>La transparencia salarial impacta directamente en&nbsp;<strong>atracci\u00f3n, compromiso y retenci\u00f3n del talento<\/strong>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Registro horario digital: de obligaci\u00f3n a trazabilidad<\/strong>&nbsp;<\/h2>\n\n\n\n<p>El <a href=\"https:\/\/sincro.es\/blog\/actualidad-laboral\/registro-de-jornada-2026-de-momento-mismas-reglas-que-en-2025\/\">registro de jornada<\/a>, obligatorio desde 2019, da un salto cualitativo en 2026. Las sanciones por incumplimiento se ver\u00e1n agravadas.&nbsp;<\/p>\n\n\n\n<p>Las empresas que a\u00fan utilizan sistemas manuales o poco trazables deben&nbsp;<strong>iniciar ya la transici\u00f3n tecnol\u00f3gica<\/strong>.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Contratos formativos y Estatuto del Becario: fin del uso discrecional<\/strong>&nbsp;<\/h2>\n\n\n\n<p>El nuevo reglamento que desarrolla el art\u00edculo 11 del Estatuto de los Trabajadores introduce:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L\u00edmites m\u00e1ximos al n\u00famero de&nbsp;<strong>contratos formativos<\/strong>&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mayor exigencia de&nbsp;<strong>vinculaci\u00f3n real<\/strong>&nbsp;entre formaci\u00f3n y puesto&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>En paralelo, el futuro&nbsp;<strong><a href=\"https:\/\/www.wolterskluwer.com\/es-es\/expert-insights\/estatuto-becario-cambios-empresas\">Estatuto del Becario<\/a><\/strong>&nbsp;\u2014a\u00fan en tramitaci\u00f3n\u2014 busca erradicar la figura del falso becario, delimitando con precisi\u00f3n qu\u00e9 constituye una pr\u00e1ctica leg\u00edtima.&nbsp;<\/p>\n\n\n\n<p>Las organizaciones con programas de pr\u00e1cticas o formaci\u00f3n en alternancia deben&nbsp;<strong>revisar su modelo antes de la entrada en vigor<\/strong>&nbsp;de estas normas.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Conclusi\u00f3n operativa<\/strong>&nbsp;<\/h2>\n\n\n\n<p>El volumen normativo de 2026 obliga a los departamentos de RR. HH. a abandonar definitivamente el rol reactivo.&nbsp;<\/p>\n\n\n\n<p>Auditar la brecha salarial, adaptar los sistemas de registro horario, revisar los programas formativos y simular el impacto de los nuevos costes de cotizaci\u00f3n&nbsp;<strong>no son tareas para el \u00faltimo trimestre del a\u00f1o<\/strong>: son prioridades del primer semestre.&nbsp;<\/p>\n\n\n\n<p>La funci\u00f3n de RR.
